Order
www.herock-shop.com is a section of the webshop www.als-shop.eu dedicated to workwear, shoes, and professional accessories, managed by ALS Sports Equipements SARL, 17 Op Zaemer, L4959 Bascharage - Luxembourg (hereinafter referred to as ALS).
The Buyer places an order on the website www.herok-shop.com by following the procedure indicated. The automatic recording systems of www.herok-shop.com are considered as proof of the nature, content, and date of the order.
The online order confirmation constitutes an electronic signature that has the same legal value between www.herok-shop.com and the Buyer as a handwritten signature.
The sale will only be concluded upon confirmation of the order by www.herok-shop.com.
This confirmation includes: a summary of the order; where applicable, a receipt of payment subject to acceptance of the transaction by the Buyer's bank.
ALS reserves the right not to confirm an order for any reason. It may also be that, due to the specific nature of the supply of farm products, some ordered products may not be deliverable on time. ALS will inform the buyer at the time of delivery and will offer either an alternative product, a refund of the product, or a credit for their next order.
Right of withdrawal and warranty
The customer has the right to withdraw from the contract within a period of 14 calendar days from the receipt of their order, without penalties and without giving any reason. The customer can submit their request via email to info@als-shop.eu. They may request to exchange products or to receive a refund. Products that have been personalized are neither exchangeable nor refundable.
During the withdrawal period, the customer shall take utmost care of the products and their packaging. Packaging must not be opened or damaged. If the customer wishes to exercise their right of withdrawal, they shall return the products in their original condition and packaging to the company's address.
The return of products must be made within a maximum period of 14 days from the exercise of the right of withdrawal.
ALS will refund the customer using the same payment method that the customer used to place the order. The refund will be made deducting any delivery charges paid by the customer or borne by ALS. The refund will be processed within 14 days after ALS acknowledges the withdrawal request, provided that ALS has received the returned products or the customer has provided proof of their shipmen
Regarding the warranty, we also apply the minimum legal warranty period of two years if the product is not compliant with the placed order. This warranty means that any product that presents defects or faults will be repaired or replaced free of charge for up to 2 years after delivery.
To the extent possible and reasonable, you have the choice between repair or replacement. You have the right to demand a reduction in price or termination of the sales contract only if repair or replacement is excessive or impossible, or if it cannot be carried out within a reasonable time.
The warranty does not cover damages resulting from normal wear and tear. Therefore, the normal lifespan of the product, which varies depending on the case, must be taken into account.
The customer's liability will be incurred for any handling of the products other than that necessary to establish the nature and characteristics of the products
Price
Prices are indicated in euros, EXCLUDING VAT, and are valid only at the time of placing the order. Prices of items may be changed by ALS at any time. Only the price displayed on the ALS website is binding between the parties.
Payment method
To pay for their order, the Buyer has the payment methods indicated during the order process.
Online payment allows the Buyer to pay for their order via the INGENICO payment platform, in a secure environment (https protocol and encryption key).
ALS reserves the right to cancel or suspend any order and/or delivery in case of refusal of payment authorization by the Buyer's credit card issuer or in case of existing commercial dispute with the Buyer.
Shipping costs, delivery times, methods
For each order, there is a flat rate ranging from €3.90 to €9.90 (excluding VAT) charged to cover preparation and delivery costs.
This flat rate does not apply if the order exceeds €100.00 including VAT for shipments to PICK-UP POINTS in Belgium and Luxembourg only.
Shipping costs, if applicable, are calculated based on the destination country and the chosen delivery method among the options offered. They are indicated to the Buyer during the order finalization before proceeding to payment.
Items are delivered to the address specified by the buyer during the order placement. By choosing delivery to a PICK-UP POINT, the buyer will be contacted by our shipping service to choose their preferred PICK-UP POINT.
The delivery time is generally 4 to 5 working days, provided that the items are directly available in our stocks or from our suppliers. Rest assured that we will do everything possible to satisfy you as soon as possible. In case of stock shortage with one of our suppliers, we may not be able to meet the expected deadline due to reasons beyond our control. We will inform you promptly in case of unusually long delays.
ATTENTION: Estimated delivery time is only valid within Luxembourg. It takes an additional 3 to 5 working days for delivery outside the Grand Duchy of Luxembourg.
The Buyer must inspect the condition of the merchandise packaging upon delivery and report any damages to ALS within 24 hours after receiving the delivery.
Personal data
The Buyer's personal data is processed in accordance with the law of December 8, 1992, concerning the protection of privacy with regard to the processing of personal data. Our policy is explained in the "legal notice" section.
Conformity
The Buyer acknowledges having consulted all information regarding the item before purchase and confirms that it fully meets their requirements.
Photographs illustrating the online catalog are not contractual and are subject to change at any time. ALS cannot be held responsible for any non-conforming and/or erroneous photograph.
Contractual modification
Any modification of the General Terms and Conditions (GTC) is binding on the Buyer within 72 hours following their publication online.
Liability
The Buyer is informed that ALS's liability, regardless of the nature of the damage, will in any case be limited to the amount of the order. Additionally, ALS cannot be held liable for any direct or indirect damages resulting from the use of the sold item.
In case of non-performance, ALS shall not be held liable if the non-performance of the sales contract or its improper performance is attributable to the Buyer, to the unforeseeable and insurmountable act of a third party outside the sale, or to a force majeure event.
Additionally, ALS cannot be held responsible for any direct or indirect damages resulting from the use of the sold item.
ALS is in no way responsible for interruptions in access to its site and the consequences that may arise from them
ALS can never be held responsible for any temporary or permanent damage or incident caused to the user's data or computer equipment during their access to the site or when visiting its pages, or generally during the transmission of files and software to their receiving device. In particular, ALS is not responsible for the potential transmission of viruses through its site.
ALS is not responsible for the fraudulent use of its distribution means and declines all responsibility in case of intrusion into its computer systems and data theft, understanding that ALS implements useful means to prevent such illicit intrusions.
Web spaces outside the domain address https://herock-shop.com, in particular those to which the user may be directed via hypertext links, are the sole responsibility of the owners of those web spaces.
Proof convention
Computer logs or "logs" processed by the computer systems of ALS Sports Equipements are considered as valid means of proof between the parties (proof of orders, electronic communications, payments and so on).
Indivisibility
If any provision of the General Terms and Conditions (GTC) is invalidated for any reason, the parties agree that the other provisions shall remain fully applicable.
Claims
Any claim regarding an online purchase must be made within 24 hours of the delivery of the order, failing which it will be considered inadmissible.
Any claim must be addressed by email to the following address: info@als-shop.com and must include the references of the concerned item and the specific reasons for the dispute.
Applicable law and competent courts
In the event of a dispute concerning the application of these terms, ALS and the Buyer agree to apply Belgian law and submit to the jurisdiction of the Luxembourg courts.
